By joining as a member of Dancemusichub.com you agree to the terms and conditions as stated in this document. This document is a binding agreement between you and Dance Music Hub Pty Ltd "DMH" (trading as Dancemusichub.com) for your use of the services provided on the site www.dancemusichub.com. You must accept and abide by all terms as presented to you in the agreement below.

DMH reserves the right to amend this agreement as necessary at anytime and it is the responsibility of the user to check the agreement before each use of the website. Continued use of the website shall be indicative of your acceptance of any amendments. By Clicking "I Agree" at the end of this document you accept to be bound by the terms and conditions contained in the Agreement.

• Service Description
  The use of the DMH website ("Site") permits you to listen to Samples ("Clips") and obtain digital Downloads of sound recordings ("Tracks") and other related digital content ("Materials") in accordance with the Terms and Conditions of this Agreement through our "Service". The Service, Clips, Tracks and Materials provided on DMH are for personal use only. You may not copy, reproduce, modify, rent, lease, broadcast, download, transmit, distribute or otherwise redistribute any content contained on the Site except for your own personal and non-commercial use. All Materials contained on the Site including (but not limited to) graphics, text, logos, editorials, audio clips, software, interface layout, source code, artwork are the property of DMH or its relevant content and technology providers and are protected by law.
• Age Requirement
  You must be at least 13 years of age or older to use this service. You must be at least 18 years of age to register to use this Service and agree to these terms and conditions on your own behalf. If you are below the age of 18 but 13 years or older you must have a parent or legal Guardian enter into this Agreement on your behalf. If you are a parent or legal guardian entering into this Agreement for your child or a child in your legal care you are fully responsible for the child's use of the service including all financial and legal liabilities incurred by the child. Some of our music may contain content deemed offensive to some individuals and minors. DMH takes no responsibility for such content and asks users to use their own discretion on this content as we cannot be held liable for any material to be unsuitable.
• System Requirements to use DMH
  Use of the Service requires a compatible computer , access to the internet and certain software. All related fees for internet access and required software shall be your responsibility
• User Registration and Account
  To use the DMH Service you must register and disclose certain information including (but not limited to) user name , password , billing information, valid email address for the purpose of creating data stored in an "Account". You agree that the data provided during registration to be contained in your "Account" is current, complete and accurate. You also agree to update the data contained in your "Account" to keep it current, complete and accurate. DMH reserves the right to deny use of any or all of its services to you should the data stored in your "Account", in our opinion, is deemed inaccurate, false or misleading. You agree that DMH may store the information you provide in your "Account" for use in credit card billing and general maintenance of your accounts in accordance with its privacy policy.
• Account Security
  You are solely responsible for maintaining the confidentiality and security of your account. You shall not reveal the personal information contained in your Account to any third party and will take all reasonable precautions to ensure the security of your username, password, membership number and all other relevant information. DMH will not be held responsible for any losses incurred due to the unauthorized use of your Account.

• Use of Content
  A "Clip" is a promotional portion of a track or music video made available when logged in for the express purpose of previewing music before purchasing a "Download". These are offered at no cost and you may play as many "Clips" as you like. You may not download, copy or capture a clip or assist in other's attempts to do so. "Download" is a Purchased Track or other Purchased digital Material that under this agreement you may:
  • Burn To CD/DVD
  • Copy to a compatible portable listening device
  • Save to your hard drive for unlimited playback
• All security technology embodied in a Download shall be an inseparable part of the Download and any attempts to remove or disable the copy protection contained in the security technology is strictly prohibited.
• The download and the Tracks, Material or any works embodied in it remains the property of the copyright owners. You are authorized to use Downloads for personal and non-commercial use. You may not alter the content in any way to create "derivative works" or play and re-digitize any download. You May not use the Downloads in conjunction with any third party content (such as films or mix cd's for commercial use) without the express written consent of the copyright owners.
• You may not share or upload Downloads to the internet on any Peer to Peer or otherwise file sharing network. Any other form of transferring Downloads to a third party who is not the original Purchaser of the Download is strictly prohibited.
• Charges and Billing
  You agree to pay for all the Downloads and Materials purchased through the DMH service and you give consent for DMH to charge your credit card as defined in your "Account" for such payment. You agree that any request to purchase from DMH will constitute your agreement to be bound by the terms and conditions of the Agreement and to pay in full the amount for each purchase including any applicable taxes. You accept that the currency converter feature displays indicative pricing only and that DMH is not responsible for any variation in price at the time of checking out.
• Termination Of Agreement
  DMH may in its discretion terminate this agreement with you or suspend your Account without notice if at any time DMH, in its opinion, believes that you have breached the Agreement and you will remain liable for any payments owing on your account.
• Rights of sale
  DMH sells Content to End Users only and will not sell products to music dealers, exporters wholesalers or any other business with an intent to sell unless specified otherwise. Any party using the content for the purpose of on selling will be found in breach of this Agreement.

  DMH reserves the right to deny sale of any Products without notice for any reason to any End User.

  DMH reserves the right to change the prices and availability of its Products without notice and does not provide refunds in the event of a price drop or promotional offering.

  All sales are final and all charges from those sales are non-refundable. DMH is not liable for any data loss or mistaken download choice once the Download is deemed successfully Delivered to you by our servers.

  DMH reserves the right to remove content from the site should the licensing rights for such content be lost or for any other reasons it deems necessary to do so.

  If you believe you have purchased a corrupted file or you are not able to download your file successfully and it is subsequently not available for re-download, you may be entitled to have the file replaced, or a credit issued. Please contact Dance Music Hub Customer Service customerservice@DMH.com. Dance Music Hub will not give cash refunds once a track has been purchased.

• Disclaimer
  By agreeing to the terms and conditions in this Agreement you accept that your use of the Site and the Service are at your own risk and that DMH will not be held liable for any losses incurred by you through the use of the Site. The service is provided to you "as is" and "as available" and without warranties either expressed or implied of any kind including (but not limited to) all implied warranties of fitness for purpose or merchantability to the extent permitted by law.

  DMH holds no responsibility for third party Materials contained within the site. This may include Products, Content, Services and Links to third party websites. You acknowledge and agree that DMH is not responsible for the evaluating this content and is not liable for any loss pertaining from its use.

  DMH will use all reasonable efforts to protect the information provided by you but you hereby accept that the submission of this information is at your own risk and agree to indemnify DMH of any liability or loss related to this information.

  Whilst DMH makes all reasonable efforts to ensure the service is uninterrupted we make no guarantee that the use of our site will be uninterrupted or without error and you identify that DMH may without notice temporarily suspend the service from time to time for maintenance purposes.

  DMH will make all reasonable efforts to ensure the security of the site from viruses, corruption, data loss or any other form of security breach but we make no warranties in this regard and shall not be liable for any loss relating to said security breaches.

• Indemnity and Waiver
  By using the Service you agree to hold harmless and indemnify DMH and it's agents, representatives, employees, licensors and content and technology partners from any and all losses, claims, demands, causes of action, and judgments (including legal fees and court costs) which arise out of your breach of this Agreement or the use of the Service.

  You shall not sue or seek to recover any damages or other payment from DMH and its agents, representative, employees, licensors, content and technology providers, and any parent or subsidiary company as a result of its decision to terminate or suspend the Agreement and service hereunder.

• Compliance with Laws
  The service is controlled and operated by DMH in Australia and this agreement shall be interpreted in accordance with the laws of Australia. The High Court of Justice in Australia shall be the exclusive court of jurisdiction. You agree to to comply with all local, state, federal, and national laws, statutes and ordinances that apply to the use of the Service.
• Privacy Notice
  At Dance Music Hub we are committed to protecting your privacy. You can visit our website without giving any personal information. However, in order to place an order it is necessary to ask for personal information such as your name, address, e-mail address and credit card details. We may use this information to respond to your requests, queries and comments or to contact you via e-mail or mail to inform you of any new products or services we may offer.

  We assure you that we will NOT allow any third party access or use of this information without your permission unless this is necessary to fulfill and provide you with the service you require from us.

  We assure you that all appropriate security measures, imposed by relevant legislation, have been taken. We promise to protect your information from unauthorised access and any improper use.
